we regret that the product you purchased is defective. Unfortunately, we have to reject your complaint.
Basically, the liability for defects is only triggered if the goods at the time of handing over to the buyer is deficient. This occurs when the goods have not agreed in the purchase contract or nature is not suitable for normal use.
However, the statutory liability for defects of the seller must be clearly distinguished from a grant made by the manufacturer's warranty. In the liability for defects not every defect of the merchandise to the buyer's requirements. A warranty claim is for example not exist if the goods as a result of ordinary wear and tear or improper use loses its intended usefulness.
